Geoffrey Curme served as managing member and co-investor in the acquisition of the senior secured debt in the bankruptcy of EpiCentre, a center-city Charlotte mixed-use development encompassing office, retail, entertainment, and hospitality elements. During a four-year investment period that included significant litigation against the original developer, the team obtained title to the project; addressed design and construction defects; completed unfinished construction; resolved disputes with governmental authorities, tenants, and other creditors; and untangled a complicated legal structure that included multiple-layer ground, building, and parking leases, as well as air rights for construction of condominium and hotel towers. The repositioned project was sold to an investor exclusive of the air rights, and to a developer for construction of the Marriott AC and Residence Inn towers.
